TERMS AND CONDITIONS OF THE CHARITY EVENT
#MoveOnUp!

§ 1

DEFINITIONS

The following expressions used in these Terms and Conditions (hereinafter referred to as: “Terms and Conditions“) shall refer to:

  1. ‘Event’ - the #MoveOnUp! charity event charity event conducted in accordance with the rules set out in the Terms and Conditions, starting from 9th of September to 29th of September, 2024;
  2. ‘Organizer’ or ‘Event Organizer’ - PERFECTTO LLC with its registered seat in Warsaw (ul. Domaniewska 17/19/133, 02-672 Warsaw), entered in the register of entrepreneurs kept by the District Court for the Capital City of Warsaw in Warsaw, XIII Economic Department of the National Court Register under the KRS number: 0000501606, NIP: 521 366 79 43 share capital: PLN 100,000.00;
  3. ‘Sponsor’ - ‘ELECTROLUX POLAND’ LLC with its registered seat in Warsaw (ul. Karolkowa 30, 01-207 Warszawa), entered into the Register of Entrepreneurs kept by the District Court for the Capital City of Warsaw in Warsaw, XX Economic Department under the KRS number 0000029692, NIP: 5210084388, REGON: 011020824 with the share capital of 272 731 500,00 PLN - paid in full;
  4. ‘Participant’ - a natural person participating in the Event who is an employee, contractor, trainee or intern of Electrolux CA EAST;
  5. ‘Beneficiary’ - the Public Benefit Organisation selected by the Club to receive the support specified in §11 of the Terms and Conditions;
  6. ‘Application’ - exclusively authorised 'Strava: Track Running, Cycling & Swimming' app for mobile devices;
  7. ‘Kilometers’ - the number of kilometres travelled by Participants in accordance with the rules of the Event, in a manner consistent with the relevant sports discipline, recorded through the Application by using the GPS system on the mobile device, which will be taken into account in determining the results of the Event;
  8. ‘Points’ - the number of points calculated on the basis of the kilometres travelled by the Participant;
  9. ‘Club’ - a Running Club or a Cycling Club with a maximum of 8 Participants, established by the Coordinator on the basis of an application submitted by the Club Leader on the Event Website;
  10. ‘Running Club’ - a club with a maximum of 8 Participants who are involved in running, walking, or nordic walking only;
  11. ‘Cycling Club’ - a club with a maximum of 8 Participants who are involved in cycling, rollerskating or rollerblading only;
  12. ‘Club Leader’ - a Participant who submitted a Club on the Event Website, having Administrator rights in the Application granted by the Coordinator;
  13. ‘Weekly Challenge’ - a time period divided into 3 phases (9 – 15 September, 16 – 22 September, and 23 – 29 September) during which Participants in a given Club can win in kind prizes on the basis of the rules set out in the Terms and Conditions;
  14. ‘Coordinator’ - a person acting on behalf of the Organiser, assigned to one or more Clubs, supervising the proper course of the Event, the observance of the Terms and Conditions and having other rights specified in the Terms and Conditions;
  15. ‘Penalty Points’ - in cases of non-compliance with the rules, as defined in the Terms and Conditions, the Coordinator may deduct points earned by the Club in question;
  16. ‘Event Website’ - the www.moveonup2024.com website
  17. ‘Application Website’ - the www.strava.com website

§ 2

OBJECTIVES OF THE EVENT

  1. The objectives of the Event are:
    1. promotion of physical activity;
    2. provision of support to the Beneficiaries of the Event, as well as promotion of charitable activities.
  2. The Sponsor of the Event will, according to the rules specified in the Terms and Conditions, provide the Beneficiaries with the support indicated in § 11 after the conclusion of the Event.
  3. The Beneficiary will be obliged to use the support transferred to them by the Event Sponsor in its entirety to help people or entities being supported by the Beneficiary.

§ 3

DURATION OF THE EVENT

The duration of the Event is planned for the period starting from September 9, 2024 (Monday), 00:00, to September 29, 2024 (Sunday), 23:59.

§ 4

PARTICIPANTS

  1. The Participant of the Event may be any natural person who is an employee, contractor, trainee or intern of Electrolux CA EAST, who has accepted the Terms and Conditions, has a mobile device with the Application installed, and has registered on the Event Website.
  2. By participating in the Event, the Participant accepts the provisions of these Terms and Conditions.
  3. One Participant may be a member of only one Running Club or Bicycle Club.
  4. The participation in the Event is voluntary and free of charge.
  5. Each Participant takes part in the Event at their own risk. In particular, the Organizer shall not be liable for any damage to person or property arising from with the Participant's involvement in the Event.
  6. The participation in the Event is not performed as a part of the Participant's employment duties and cannot be performed during the Participant's working hours or at the place where the Participant is employed.
  7. Any Participant may opt out of the Event at any time via the Application or the Event Website.
  8. In the event that a Participant opts out of the Event, the Kilometres earned by the Participant prior to opting out will not be lost and will be credited towards the total points awarded to the Club the Participant was a member of.
  9. The maximum total number of Participants taking part in the Event is 200.
  10. The Event Organizer does not collect or process the personal data of Participants either during or after the Event.

§ 5

REGISTRATION

  1. On the Event Website, Club Leaders register by selecting a Running Club (‘Running’ under ‘Sport’ in the App) or Cycling Club (‘Cycling’ under ‘Sport’ in the App) and providing their name, chosen club name and workplace location.
  2. After registration by the Club Leader, the Coordinator verifies the application.
  3. If the application is accepted, the Coordinator establishes the submitted Club in the Application, at the same time granting Administrator rights to the Club Leader.
  4. The Club Leader accepts the applications of all other Participants to their Club.
  5. The Coordinator ensures that the registration process is conducted correctly and contacts the Club Leader and/or the Event Organiser in the event of problems or non-standard situations.

§ 6

CLUBS

  1. The maximum number of participants for each Club is 8 people.
  2. Clubs are divided into Running Clubs and Cycling Clubs.
  3. Clubs compete among themselves in two categories: Running Clubs and Bicycle Clubs. The Event does not include a combined competition between Running Clubs and Bicycle Clubs.
  4. An additional person enrolled in each Club, in addition to the Club Leader and the Participants, shall be the Coordinator, who watches over the proper performance of the Event. The Coordinator shall be also responsible for the observance of the Terms and Conditions and may impose penalty points to a given Club.
  5. Within the scope of the Event, the Participants may perform the following sports activities, which will be scored:
    1. In scope of the Running Club – running, walking, and Nordic walking;
    2. In scope of the Cycling Club – cycling, roller skating or roller blading.

§ 7

ACTIVITY SCORING

  1. Each 1 kilometre spent actively and registered by the Application is converted into 1 Point for the respective Running Club or Cycling Club.
  2. Partial kilometres will be rounded according to the following scheme:
    0 km - 0,5 km = 0 points
    0,51 km - 1 km = 1 point
    1 km - 1,5 km = 1 point
    1,51 km - 2 km = 2 points
    etc.
  3. Within the Running Club, a Participant performing an activity (running, walking or Nordic walking) shall select the “RUN” option in the Application.
  4. Within the Bicycle Club, a Participant performing an activity (cycling, roller skating, or rollerblading) shall select the “RIDE” option in the Application.
  5. Only outdoor sports activities will be scored.
  6. Within the framework of the Challenge, the Participants will collect Points starting from September 9th, 2024, 00:00, until September 29th, 2024, 11:59.
  7. After each Weekly Challenge, the Scores of the Participants in the Application will be reset to zero.
  8. The final score of a given Club will consist of the sum of points earned by all Participants of a given Club during the entire duration of the Challenge.
  9. Only activities that have been registered in the Application and confirmed by a map with the marked route of the activity registered by the GPS module within the Application will be scored.
  10. Only activities that have been registered individually by the Participant in the Application installed on their mobile device will be scored. It is not possible to copy activities from another Participant's Application.
  11. In the event of copying an activity from another Participant's Application, all Points earned from the copied activity will be cancelled, and additional Penalty Points may be assigned to the respective Running Club or Cycling Club (effectively reducing their point tally).
  12. The activities of Participants that do not have a graphic map with a marked route will not be taken into account when calculating Points.
  13. In exceptional situations, the Organizer reserves the right to ask Participants to send a photo confirming the performance of the activity.
  14. Points will be awarded only for activities that are recorded outside working hours and outside the Participant's place of work.

§ 8

PENALTY POINTS

  1. In justified cases, the Coordinator may apply Penalty Points to a given Club by deducting a certain number of Points from the score.
  2. In case of violation of the Terms and Conditions by the Participant, the Coordinator has the option to apply a penalty consisting in suspension of the Participant's contribution to the Event for a period of 3 days. During this time, the Participant's results will not be taken into account in the scoring of the entire Club to which the Participant is assigned.
  3. In the case of a repeated violation of the Rules by a Participant who has been suspended, the Coordinator has the option to impose a penalty consisting in deducting 10% of the points (rounded up) of the Club to which the Participant who repeatedly violates the Rules belongs.

§ 9

RESULTS

  1. Throughout the duration of the Event, the Event Website www.moveonup2024.com will be constantly updated with the scores of all Clubs.
  2. Updated scores for all Clubs will be published by 12:00 PM (noon) the following day.

§ 10

CONCLUSION OF THE EVENT

  1. The Event ends on the 29th of September, 2024, at 23:59.
  2. On the 4th of October, 2024 (Friday), the official results will be announced and prizes will be awarded to the winners.

§ 11

REWARDS

  1. As part of the announcement of the results (which will happen on the 4th of October, 2024), the Event Organizer will identify one Running Club and one Cycling Club that have scored the most points throughout the duration of the Event.
  2. The identified top Clubs will receive the following support from the Sponsor to the selected Beneficiaries:
    1. The Running Club that takes the 1st place will receive selected Electrolux products with a total value of €1500, which will be donated to the Public Benefit Organization selected by the winning Running Club.
    2. The Cycling Club that takes the 1st place will receive selected Electrolux products with a total value of €1,500, which will be donated to the Public Benefit Organization selected by the winning Cycling Club.
  3. Każdy kilometr przebyty przez Uczestnika w ramach wyzwania #ruszsienawiosne! będzie przekładał się na kwotę, jaką Sponsor przekaże na rzecz wybranych Beneficjentów. W zależności od rodzaju Klubu przelicznik prezentuje się następująco:
    1. W przypadku Klubu biegowego każdy pokonany kilometr to kwota 0,30 zł brutto, która zostanie przekazana przez Sponsora na rzecz wybranego Beneficjenta.
    2. W przypadku Klubu rowerowego każdy pokonany kilometr to kwota 0,10 zł brutto, która zostanie przekazana przez Sponsora na rzecz wybranego Beneficjenta.
  4. Each Participant belonging to a Running Club that takes the 1st place in the competition between Running Clubs and obtains the highest number of points from the activities undertaken as part of participation in the Event will receive a prize from the Event Organizer in the form of a gift card with a gross value of €150 to be used at www.amazon.com.
  5. Each Participant belonging to a Cycling Club that takes the 1st place in the competition between Cycling Clubs and obtains the highest number of points from the activities undertaken as part of participation in the Event will receive a prize from the Event Organizer in the form of a gift card with a gross value of €150 to be used at www.amazon.com.
  6. Both male and female Participant, who will travel the highest number of kilometres in the competition between all Running Clubs or Cycling Clubs, will receive a prize in the form of the Xiaomi MI Band 8 smartband.
  7. Each Participant belonging to a Club that takes the 1st place within the competition between all Running Clubs and Cycling Clubs and obtains the highest number of points within the Weekly Challenge will receive the following prize from the Event Organizer:
    1. In the first Weekly Challenge (September 9 – 15), the prize in the running category will be a roller kit, and in the cycling category it will be a bicycle bag containing the necessary repair items;
    2. In the second Weekly Challenge (September 16 – 22), the prize in the running category will be a reflective vest for runners, and in the cycling category it will be a bicycle backpack;
    3. In the third Weekly Challenge (September 23 – 29), the prize in the running category will be an LED head torch, and in the cycling category it will be a LED bicycle light.
  8. Prizes included in paragraphs 4., 5., 6. and 7. may not be exchanged for cash equivalent.
  9. The Participant is not entitled to reserve any special features of the prizes.
  10. The Participant will not be charged with the costs associated with the delivery of the prize.

§ 12

TERMS AND CONDITIONS

  1. The Event Organizer is entitled to make changes to the Terms and Conditions during the duration of the Event.
  2. The changes are effective at the time they are published on the Event Website.
  3. The content of the Terms and Conditions, including any changes thereto, will be available at the registered seat of the Organizer and on the Event Website.

§ 13

CLOSING PROVISIONS

The law applicable to all legal relations arising in connection with the Event shall be Polish law.
