PRIVACY POLICY

According to Article 13 (1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (Official Journal of the EU L 119 of 04.05.2016, page 1), hereinafter referred to as ‘GDPR’, we inform you that:

  1. The Controller of your personal data is a company under the name of Perfectto LLC with registered office in Warsaw (postal code 02-672), ul. Domaniewska 17/19/133, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of 3.Warsaw in Warsaw, XII Economic Department of the National Court Register under the number 0000501606, NIP 5213667943, REGON 14714585900000.
  2. The Controller has designated a person who can be contacted on all matters relating to the processing of personal data and the exercising of rights related to data processing at: pawel.kozak@perfectto.pl.
  3. In order to ensure data integrity and confidentiality, the Controller has implemented procedures to allow access to personal data by authorized persons to the necessary extent. The Controller uses solutions to ensure that all operations on personal data are recorded and that they are performed only by authorized persons.
  4. In addition, the Controller shall take all necessary steps to ensure that its subcontractors and other cooperating entities also provide guarantees of the application of appropriate security measures whenever they process personal data. The Controller conducts a risk analysis on an ongoing basis and monitors the adequacy of the data security measures applied to the identified risks.
  5. The legal basis for data processing is:
    1. The performance of a contract, i.e., taking part in the #MoveOnUp! charity event to which contract the person to whom the data relates is a party, in accordance with the provisions of Article 6 (1)(b) of the GDPR;
    2. The legitimate interest of the Controller, in accordance with Article 6 (1)(f) of the GDPR, consisting in conducting the #MoveOnUp! charity event, i.e., a project organized through the www.moveonup2024.com website.
  6. The personal data that are processed are limited to the following: first name, last name, email address, and place of work.
  7. In connection with the conduct of a charity event by the Controller requiring the processing of personal data, we would like to inform you that this data may be disclosed to other external entities cooperating with the Controller, including those operating IT systems and equipment, as well as entities providing legal, accounting or financial services, as well as to marketing agencies.
  8. Other disclosure of personal data to competent authorities or third parties who request such information may be made only on an appropriate legal basis and in accordance with the provisions of applicable law.
  9. The period of data processing depends on the purpose of the processing, and may also be based on regulations if they constitute the basis for processing. If the data is processed on the basis of the legitimate interest of the Controller, the data shall be processed for a period of time to enable its implementation or until an effective objection to the processing is made. If processing is based on the consent to data processing, data is processed until the consent is withdrawn. If the processing of personal data is necessary for the conclusion and performance of an agreement, the data shall be processed until the agreement is terminated.
  10. The period of data processing may be extended if the processing is necessary for the establishment, investigation or defense against possible claims, and after this period, only in the case and to the extent required by law. After the indicated period, the data will be irreversibly deleted or anonymized.
  11. Providing of the personal data is completely voluntary, but necessary in order to participate in the charity event. Failure to provide the required personal data will result in the Controller's inability to perform the activities indicated above.
  12. Decisions will not be made by automated means with respect to the personal data provided, in accordance with Article 22 of the GDPR.
  13. The persons to whom the data relate have the following rights:
    1. The right to be informed about the processing of personal data;
    2. The right to rectification of data;
    3. The right to restrict processing;
    4. The right to obtain a copy of the data;
    5. The right to transferring of personal data;
    6. The right to lodge a complaint – a person who believes that their personal data is being processed in violation of the law, the provisions of the GDPR, or other data protection regulations may lodge a complaint with the President of the Office for Personal Data Protection;
    7. The right to be forgotten – the data subject has the right to demand from the Controller the immediate deletion of personal data concerning them.
